Terms of Service

Welcome to SimPT. These Terms of Service ("Terms") govern your use of the SimPT clinical reasoning simulator at simpt.us (the "Service"), operated by [3D Medical LLC / entity name and state of formation] ("SimPT," "we," "us").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What SimPT is — and is not

SimPT is an educational simulation tool for physical therapy students and clinicians. It presents fictional, computer-generated patient encounters for practice and learning.

2. Eligibility and accounts

You must be at least 18 years old to use the Service. You agree to provide accurate information at signup, keep your login email current, and not share your account. Sign-in links sent to your email are for you alone. You are responsible for activity on your account. Some features require an invite code; codes may be revoked or expire.

4. User feedback and endorsements

The Service may ask for your feedback on cases (e.g., whether a simulated patient presented realistically, or reports that something seems clinically off). You grant us a perpetual, royalty-free license to use feedback you submit to operate and improve the Service. Endorsement counts shown in the Service are aggregate user feedback, not clinical review.

5. Faculty-created content

Users with case-authoring access retain no exclusive rights in the underlying SimPT case format or engine. As between you and SimPT, [OPTION A: you assign to SimPT / OPTION B: you retain ownership of your authored case briefs and grant SimPT a perpetual license to host, adapt, display, and use them to operate and improve the Service — DECIDE BEFORE INSTITUTIONAL SALES]. 6. Intellectual property

The Service, including software, case content, grading rubrics, and design, is owned by SimPT or its licensors and protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal educational purposes (or, for institutional customers, as set out in the applicable agreement).

8. Availability and changes

The Service is provided on an evolving basis. We may add, change, or remove features, cases, or scoring approaches, and may suspend the Service for maintenance. We aim for high availability but do not guarantee uninterrupted access.

9. Third-party services

The Service uses third-party providers, including AI model providers (Anthropic), cloud hosting (DigitalOcean), email delivery (Resend), and payment processing (Stripe). Their processing of data is described in our Privacy Policy.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF EDUCATIONAL CONTENT, OR NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT SIMULATED CASES, FINDINGS, OR AUTOMATED FEEDBACK ARE FREE OF CLINICAL ERROR, OR THAT USE OF THE SERVICE WILL PRODUCE ANY PARTICULAR ACADEMIC OR EXAMINATION OUTCOME.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIMPT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR ACADEMIC OPPORTUNITY, ARISING FROM USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR $50 IF YOU HAVE PAID NOTHING. Some jurisdictions do not allow certain limitations; these apply to the fullest extent permitted.

12. Indemnification

You will indemnify SimPT against claims arising from your breach of these Terms, your misrepresentation of credentials, or content you author or submit.

13. Termination

You may stop using the Service and request account deletion at any time. We may suspend or terminate access for breach of these Terms, with notice where practicable. Sections that by their nature should survive (IP, disclaimers, liability limits, indemnity) survive termination.

14. Governing law and disputes

These Terms are governed by the laws of the State of [Idaho], without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in [Idaho / county], and the parties consent to their jurisdiction.
